Sa unang araw ng pagdinig ng Merito ng kaso ng Pilipinas sa arbitral tribunal sa The Hague Netherlands, pinamalian ng delegasyon ng Pilipinas ang batayan ng China sa claim nitong Nine-Dash line sa West Philippine Sea.

Ayon kay Deputy Presidential Spokesperson Abigail Valte, iprinesenta ni Andrew Loewenstein, abugado ng Pilipinas, ang walong mapa ng China, na isa dito ay mula pa noong panahon ng Ming Dynasty na nagpapakita sa teritoryo ng China na hindi kabilang ang claim nitong Nine-Dash line.

Binigyang diin din aniya ni Loewenstein na kahit tanggaping may Nine-Dash line sa United Nations Convention on the Law of the Sea o UNCLOS, hindi naman na-satisfy ng china ang isa sa requirement na wala itong tuluy tuloy na Exclusive Control sa West Philippine Sea sa mahabang panahon.

“Andrew Loewenstein argued that even assuming, for the sake of argument, that a claim of historic rights can exist after the UNCLOS, China has failed to satisfy the requirements to establish the claim, namely: a continuous exercise of exclusive control for a long period of time over the said area. Loewenstein presented eight maps, the first of which dates back to the Ming Dynasty, to show that China’s territory did not include that which it claims now under the Nine-Dash Line.”pahayag ni Valte.

Bukod dito, tinalakay naman aniya ni Professor Bernard Oxman ang paglabag sa batas ng claim ng China sa mga teritoryong hindi nakasaad sa United Nations Convention on the Law of the Sea o UNCLOS at kung paano nito pinaghihimasukan ang coastal states tulad ng Pilipinas.

Dagdag pa ni Valte, tinalakay din ni Principal Counsel Paul Reichler sa harap ng tribunal ang nature ng sinasabing historic rights claim ng China at kung paano ito kinuha ng China sa UNCLOS na bagay namang hindi nakasaad sa mga probisyon ng naturang Convention.

Binanggit din aniya ni Reichler sa tribunal ang paggiit ng China sa anila’y exclusive rights nito sa West Philippine sea at kung paanong pinagkakaitan nito ang pangingisda at exploration activies ng mga Pilipino sa inaangkin nitong teritoryo.

“Principal Counsel Paul Reichler discussed the nature of China’s historic rights claim and how these purported historic rights, supposedly derived under the United Nations Convention on the Law of the Sea (UNCLOS), in fact do not exist under the provisions of the convention. Mr. Reichler mentioned that China has asserted exclusive rights over the areas covered by the Nine-Dash Line and has deprived the Philippines of fishing and exploration activities.”pahayag ni Valte.
